These terms govern your use of the CoverTurn website at coverturn.com. By visiting or using the site, you agree to them. If you don't agree, please don't use the site.
01The agreement
This is an agreement between you and CoverTurn, Inc., a Delaware corporation ("CoverTurn", "we", "us", "our"). Throughout these terms, "the site" refers to coverturn.com and all subdomains and pages on it. By accessing, browsing, or using the site, you confirm you have read these terms, agree to be bound by them, and are at least 18 years old or have permission from a parent or guardian.
These Terms of Use are separate from our Privacy Policy and from any signed service agreement we may enter into for client work.
02Permitted use
You may use the site for lawful purposes only. You agree not to:
- Use the site in any way that breaks any applicable national or international law.
- Use the site to send or upload spam, malware, viruses, or any other harmful or fraudulent material.
- Attempt to gain unauthorised access to any part of the site, server, or connected systems.
- Scrape, mirror, or systematically copy content from the site without our prior written consent. (This includes using AI training crawlers without permission.)
- Use the site to impersonate any person, business, or entity, or to misrepresent your relationship to anyone.
- Reverse-engineer, decompile, or attempt to extract source code from anything we have published.
We reserve the right to refuse service, block access, or take any other lawful action against anyone who breaches these terms.
03Intellectual property
Everything you see on the site, including text, copywriting, design, layout, graphics, photography, illustrations, motion, video, code, case studies, brand systems, and the CoverTurn name and word mark, is owned by CoverTurn or used under licence. It is protected by copyright, trade mark, and other applicable intellectual property laws.
You may view, share, and link to the site for personal, non-commercial purposes. You may not copy, reproduce, republish, modify, sell, or distribute any part of the site for commercial purposes without our prior written permission.
Case studies featuring client work are published with the client's permission where applicable. Client logos, brands, and trade marks belong to their respective owners.
04Your submissions
If you submit a project brief through the site, send us an email, or otherwise share information with us:
- You confirm the information is accurate, complete, and yours to share.
- You retain ownership of the content of your submission.
- You grant CoverTurn a limited, non-exclusive, royalty-free licence to read, review, and respond to your submission for the purpose of evaluating it and replying to you.
- You agree not to submit anything illegal, infringing, confidential to another party, or otherwise inappropriate.
05Services and quotes
Information about our services, scopes, and prices on the site is for general information only. It does not constitute a binding offer. Any engagement with CoverTurn is governed by a separate signed service agreement that we will share before work begins.
Pricing displayed on the site is in US dollars and is subject to change. The prices that apply to a specific engagement are those quoted in your signed agreement, not the prices that may appear on the site at the time you submit a brief.
06Third-party links and content
The site may include links to external websites and third-party services (for example scheduling tools, social platforms, or payment processors). These services are not under our control. We are not responsible for the content, privacy practices, or accuracy of any third-party site we link to. Linking to a third party does not imply endorsement.
07Disclaimer of warranties
The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, CoverTurn makes no warranties, express or implied, about the site, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or that the site will be uninterrupted, error-free, or secure.
Nothing on the site constitutes legal, financial, technical, or business advice. Information presented in case studies and blog posts reflects our experience and opinion at the time of writing.
08Limitation of liability
To the fullest extent permitted by law, CoverTurn, its directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the site, even if we have been advised of the possibility of such damages.
Where liability cannot be lawfully excluded, our total aggregate liability arising out of or in connection with the site is limited to one hundred US dollars ($100).
Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be lawfully limited or excluded.
09Indemnification
You agree to indemnify and hold CoverTurn harmless from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the site in breach of these terms, your violation of any law, or your violation of any third-party right.
10Governing law
These terms and any dispute or claim arising out of or in connection with them, the site, or our services are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.
You agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute, except that we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
If you are based in the United Kingdom or European Union, this clause does not affect any mandatory consumer protection rights you have under your local law.
11Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page will always show the most recent change. Material changes will be flagged with a notice at the top of the page for a reasonable period. Your continued use of the site after a change means you accept the updated terms.
